Course outline
Aim: To assist practitioners in focusing the general principles of Wills drafting on the needs and requirements of an elderly and vulnerable client base with reference to a case study.Outcome: Participants will be confident and expert in their drafting of Wills for their elderly and vulnerable clients.
Agenda:
- The challenge of testamentary capacity & knowledge and approval – round-up of recent cases
- The challenge of the ‘golden rule’ – the practicality of involving appropriate medical assistance
- The challenge of undue influence – taking care over who is actually providing the instructions
- The challenge of ‘acting promptly’ – risk management
- The challenge of being paid an appropriate fee – the difficulty of compliance with our professional rules
- Use of a case study example to help illustrate the above
